Terms & Conditions of Service

EAV Networks Limited (EAV Net) Terms & Conditions 2024

These terms and conditions of business are between EAV Networks Limited and ‘the client’, ‘the customer’ or ‘the business’ (you). It supersedes any earlier written or oral arrangement between you and EAV Networks Limited.

 

The headings in these terms and conditions are for convenience and shall not affect its interpretation.

 

1    Introduction

 

1.1    These are terms and conditions of EAV Networks Limited, ‘the company’ EAV Networks Limited, may be refereed to as the company, EAV, EAV Net or other trading names used by EAV Networks Limited or sister company EAV Group Limited.

1.2    These terms and conditions are agreed to by yourself (‘the client’, ‘the customer’, or ‘the business’) when you agree to use our services, sign up to our service, agree a quotation, or continue to use our service or any other agreement made between the company and yourself.

 

1.3    Our website ‘www.eavnet.co.uk' will hold our latest terms and conditions which will change as the company develops and offers more services. The latest terms and conditions always supersedes any other terms and conditions that have previously been listed on the website.

2    Eligibility 

 

2.1    EAV Networks Limited does not guarantee service or the speed of service until a survey is taken place, this maybe free on selected packages but is wholly at the companies discretion. Repeat surveys / installations for the same address / customer / business will be charged a fee of £120, this fee is calculated upon each installation.

 

2.2    EAV Networks Limited reserves the right not to provide a service without any reason given.

2.3    Reselling or providing outside use of our services will result in the termination of your services without notice unless EAV Networks have explicitly given permission in wiring to do so. This incudes providing access to your router from neighbouring properties or providing access to people or business from outside the property it was intended for.

2.4.   EAV Networks Limited reserves the right to cancel a service with no notification period and without reason, billing will be calculated for the customer / business up to this point. 

2.5.   Any discounts / offers are solely at our discretion and can be dependent on site type / location.

 

 

3    Equipment Rights

3.1    All equipment installed by EAV Networks Limited or EAV Group Limited is owned outright by EAV Network Limited, this incudes but is not limited to routers, wireless receivers, telephone hardware, cabling & mounted hardware.

3.2    Damage, theft or loss of equipment will result in a charge to you the customer / business of £120 for each service. Equipment used on client sites should be insured by the customer or business at their own costs and are the sole responsibility of the client.

3.3    Failure to allow us to remove or maintain equipment will also result in a charge to you the customer / business of £120 for each service.  This includes but is not limited to when a service is terminated or is no longer is use.

4    Installation

4.1    Upon signing up to our service you will be offered a survey date with a AM / PM appointment. The AM slot is usually between 8.30am & 12.00pm, the PM slot is usually between 12.00pm & 17.00pm.

4.2    Upon a successful survey the installation is carried out with a sufficient wireless receiver and router. (Please refer to section 3 regarding ownership and maintenance rights).

4.3    The router shall be installed at a convent location as to make it efficient installation and cabling route to the wireless receiver, other installation charges may occur should the router need to be installed at a greater length to the wireless receiver or if the installation requires additional time / materials.

4.4    Should equipment need to be recalibrated / aligned / set up there maybe additional charges, charges will be at the discretion of EAV Networks Limited.

4.5    Additional labour charges are billed at £60 per hour plus additional material costs, replacement equipment charges are billed at £120 for standard services.

 

5    Right to Cancel

5.1    Once signed up to our service you have an initial 14 day cooling off period to cancel your services without penalty. You will only be charged for your services up to the point of removal / cancellation.

5.2    If you cancel your service mid contract you will be liable to pay for the remained of the contract balance.

 

5.3    If out of contract you will automatically be placed onto a rolling monthly contract (30 day).

5.4   Cancellations will need to be carried out in writing by raising a ticket on the portal requesting a cancellation. This will require 30 days notice where we will arrange an appointment to remove our equipment, if equipment is missing / damaged or can't be retrieved it will incur a charge as in section 3 & 4.

6    Network Specifics 

6.1    Broadband packages provided state "Up to" upload & download speed limits, this is monitored and created using traffic shaping as an industry standard. These speeds are monitored using our in-house servers including statistics and performance history. These speeds maybe dependant on what hardware is connected to your router we provide and we do no recommend relying on speed test websites to establish your bandwidth we provide, if you are experiencing issues we recommend raising a ticket where we can perform an in-house speed test directly for your router to the World Wide Web. 

6.2    Each service will be provided with a CGNAT non routable IP address, this can be upgraded at our discretion to a routable static IP address at a monthly charge upon request.

 

6.3    Nothing should be connected to our wireless receivers except the router we provide, should you want to use your own router or network set up, you router provided by us will be set up into "bridge mode", allowing you to run your own external network. Should this condition be broken the service will be terminated immediately without notice. We do not provide access to the settings of the routers we provide. Port forwarding, open port, LAN settings, & wireless settings can be changed by submitting a request on the portal.

6.4    Use of our services for illegal or immoral will result in immediate termination of the service without notice.

 

7    Liability

7.1    EAV Networks Limited does not accept any liability for delays when carrying out scheduled or unscheduled works. Delays to installation or maintenance works are generally kept to a minimum but we can’t guarantee that all works will be carried out on time every time.

7.2    EAV Networks Limited does not accept liability for viruses malware or any other harmful data or applications that are transmitted over or on our network or routers provided.

7.3    EAV Networks Limited does not accept liability for momentary drops or prolonged drops in service which may substantially affect devices such as servers, CCTV, alarms or anything else our service is being used for. We aim to respond to all connection issues within 7 days and major connections issues within 24 hours, however there maybe times when we exceed these timeframes due to other parameters.

8    Complaints

 

8.1    Complaints should be raised on the online portal in the form of a ticket or in writing via email or post.

9    Fair Usage Policy

9.1    Where services come with restrictions or usage allowance, services will be paused if the limits are exceed and will renew each month.

9.2    Where services come with an unlimited allowance, this will be subject to fair usage and will be monitored with bandwidths adjusted to allow for a balance and fair use to all connected customers. This limitation as part of the fair usage policy is at EAV Networks discretion and will be monitored to allow for fair use of the entire network for all customers connected.

10   Payment

10.1   Payments for monthly services will be taken using our direct debit partner GoCardless. EAV Networks Limited does not accept liability for incorrect processed payment by GoCardless.

10.2   Failure to make payments in correspondence with the invoice due date or failed direct debits will result in a £20 admin fee as well as an interest rate 8% above the Bank of England Base Rate (calculated daily). If payments for outstanding invoices are not made within 7 days the service maybe temporarily stopped until payment is made in full.

10.3   The first invoice will be prorated for the remainder of the month and the direct debit will be taken within 7 days. Following on from the first invoice, billing will be carried out on the 1st of each of the months for the month of service, the direct debit will be taken on the same day (failed direct debits will incur additional fees as per 10.2).

11    General

11.1    These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorised representative and you. Our terms and conditions will prevail over any terms and conditions used by you or contained, set out or referred to in any documentation sent to us by you. By entering into a contract with us you agree irrevocably to waive the application of any of these terms and conditions.

11.2    Pictures and literature inc emails and letters produced by EAV Networks Limited remain the sole property of EAV Networks Limited unless stated in wiring by a director of EAV Networks Limited. These items should not be made public or shared with anyone else unless given permission in wiring by EAV Networks Limited.

11.3    These terms and conditions, and all contracts awarded between us and you, shall be governed and construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Law.

11.4    EAV Networks Limited, reg no. 15285470, is a company incorporated in England and Wales.
